These Terms & Conditions ("Terms") govern your access to and use of AppLaunchFlow (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the Service itself
• Reverse engineer or attempt to extract source code
• Use the Service in a way that disrupts or abuses system resources
• Circumvent usage limits or paywalls

4. Commercial Use & Generated Output

You own all outputs generated through your use of the Service, including but not limited to screenshots, illustrations, translations, and copy ("Generated Content").

We retain all rights to:

• The Service
• The underlying software
• Design systems, templates, and models used to generate outputs

You are solely responsible for ensuring that your Generated Content does not infringe third-party rights.

5. User Content

You retain ownership of any content you upload or submit ("User Content").

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use it solely to operate, maintain, and improve the Service.

6. Subscriptions, Billing & Renewals

• Some features require a paid subscription.
• Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• Subscriptions automatically renew unless canceled before the end of the billing period
• You may cancel at any time; access remains until the end of the current period
• We do not provide prorated refunds for unused time
• All payments are processed securely via third-party providers such as Stripe.

7. One-Time Purchases

• Certain features may be offered as one-time purchases (e.g. export credits).
• One-time purchases are non-refundable
• Unused credits do not expire unless stated otherwise
• One-time purchases do not grant subscription benefits

8. Refund Policy

Unless required by law, all payments are non-refundable.

For EU customers, by purchasing digital services and accessing them immediately, you expressly waive your statutory right of withdrawal under applicable consumer protection laws.

9. Fair Use & Abuse

We reserve the right to enforce reasonable usage limits to prevent abuse, excessive load, or misuse of the Service.

We may suspend or terminate accounts that:

• Attempt to bypass limits
• Use the Service for unlawful purposes
• Abuse system resources
• Violate these Terms

10. Intellectual Property

All intellectual property rights in the Service (excluding Generated Content and User Content) are owned by us or our licensors. Nothing in these Terms transfers any ownership rights to you.

11. Disclaimer

The Service is provided "as is" and "as available".

We make no warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or lost-profit damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect upon posting. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles.
